These terms
These terms are the agreement between you and Lotwize ("Lotwize", "we") for use of lotwize.ai and the Lotwize application. By creating an account or using Lotwize you accept them. If you do not accept them, do not use Lotwize.
Availability and changes
Lotwize is provided "as is". We may add, change or withdraw features at any time. We will give you reasonable notice of a change that materially reduces what the service does for you.
Who may use it
You must be at least 18 years old and able to enter a contract. You need your own eBay seller account, in good standing, that you are authorised to use. Lotwize publishes to the United States eBay marketplace only, so that account must be able to list there; it does not publish to eBay sites in other countries. Lotwize is for your own selling activity: you may not resell or share your access, and one person may not run several accounts to circumvent limits.
Your account
Keep your sign-in details confidential and secure. You are responsible for what happens under your account. We recommend turning on two-factor authentication in Settings. Notify us promptly at support@lotwize.ai if you believe someone else has access to your account.
What Lotwize does with your eBay account
When you connect eBay, you authorise Lotwize to act on your instructions through eBay’s official APIs: to create, publish, revise and end listings, to read your business policies and your active listings, and, only if you switch it on, to add your listings to a Promoted Listings campaign you have chosen.
You remain the seller. Every listing Lotwize publishes is your listing, sold by you, under eBay’s own User Agreement and fee schedule. eBay charges you directly; Lotwize does not collect or handle your sales proceeds. eBay’s policies apply to your listings regardless of what Lotwize suggested, and eBay may remove a listing or restrict your account under its own rules. You can disconnect eBay at any time in Settings, which stops Lotwize acting for you; listings already published stay live and remain yours.
Your content and your listings
Your photos, your condition notes and your listing text remain yours. You give Lotwize permission to store and process them for one purpose, running the service for you: identifying the part, drafting the listing, publishing it to eBay, and keeping your drafts and backups. That permission ends when you delete the content or your account. We do not use your content to advertise, and we do not sell it.
You are responsible for the accuracy and legality of what you publish: that you have the part, that it is described truthfully, that your photos are yours to use, and that the listing complies with eBay’s policies and the law where you sell. Do not use Lotwize to list counterfeit, stolen, recalled or unsafe parts.
Corrections you submit
When an identification is wrong you can correct it. Submitting a correction sends it for review and grants us a perpetual, non-exclusive, royalty-free licence to use that correction, meaning the values you changed, what we had predicted, and the photo it refers to, to evaluate and improve the models behind Lotwize, for all sellers, not only your own account. You keep ownership of the photo and of everything else you upload; this licence covers only what is needed to make the tool more accurate.
Correcting a field on your own listing without submitting it grants us nothing. What happens to a submitted correction when you delete your account, including what deletion can and cannot undo once a model has been trained, is set out in our Privacy Policy.
AI assistance, not guarantees
Lotwize uses automated identification and writing to produce a draft. Identifications can be wrong. Descriptions and item specifics are suggestions. The price is yours to set. Nothing reaches eBay until you publish it, and reviewing it before you do is your responsibility. Lotwize deliberately leaves a field blank instead of guessing at its value.
No decision with a legal or similarly significant effect on you is made automatically.
Fees
Lotwize is sold as a monthly subscription. You choose a plan when you sign up, and the plan is what lets you use the paid tools. Nothing is prepaid: there is no credit balance, and no minimum amount to add before you can publish. The plans are $49 a month for up to 100 headlights, $89 for up to 200, $199 for up to 500, $349 for up to 1,000, and $749 for up to 2,500.
The trial. Every plan opens with a 7-day trial, and you start it yourself. Starting it sets the 7 days running; the paid tools stay closed until you do. You are not charged during the trial, however much you list. It ends 7 days after you start it, and your subscription begins that day.
“Up to” means per billing month, and an unused allowance does not carry over. A month in which you list nothing still costs the price of your plan.
Going over your plan. You are not stopped at your limit. Anything past it is charged at five cents a headlight more than your plan’s own rate — 55 cents on the $49 plan, 50 cents on the $89 plan, 45 cents on the $199 plan, 40 cents on the $349 plan, and 35 cents on the $749 plan. Inside the allowance a headlight costs 50 cents on the $49 plan, 45 cents on the $89 plan, 40 cents on the $199 plan, 35 cents on the $349 plan, and 30 cents on the $749 plan. A headlight is charged in two parts: 10 cents when the identification runs, whether or not you go on to list that draft, and the rest of the rate when eBay accepts the listing. You are not charged for a draft you never submit, or for a listing eBay turns down.
Amounts are worked out to a tenth of a cent and nothing is rounded. Where a total does not land on a whole cent, the remainder is carried to your next month, not rounded up or dropped.
Changing plan. You can move to a different plan at any time, and what you have already paid for the current month goes against it. There is a ceiling of $500 a month on how far past your allowance you can go before the paid tools stop; you can change plan and carry on immediately.
Your subscription starts when your trial ends, and you are billed on that date every month. If your trial ends on the 9th you are billed on the 9th, and on the 9th of each month after it; it is not the end of the calendar month. Each bill covers your plan and anything past its allowance. You can see what you have used, and what it comes to, in the app at any time. If a bill goes unpaid we pause the paid tools until it is settled. Your drafts, your preferences and your published listings are unaffected, and so is your eBay connection: pausing stops new work, it does not touch what you have already done.
Deleting your account does not refund the month. A plan is bought for the billing month it covers, and by the time an account is closed that month has been provided. Nothing is refunded on deletion.
Deleting your account settles what you owe. If you have gone past your plan’s allowance, that overage is charged to your card as the account closes, and your subscription then ends. Only the overage is taken: the month itself is already paid, and an account inside its allowance pays nothing further. Closing the account is not a way to avoid what you owe.
These prices can go up. As the identification model improves and further features ship, we may change what we charge for existing or new capabilities. We will notify you before a change takes effect, it will never apply to a month you have already paid for, and you may change plan or stop using Lotwize before it does.
eBay’s own fees, and any Promoted Listings ad fees you incur, are between you and eBay and are payable regardless of what Lotwize did.
Text messages
If you turn on text-message two-factor authentication, you consent to receive one-time sign-in codes by SMS at the number you give us. These are account-security messages, not marketing. Frequency is one message per sign-in, plus one when you enrol. Message and data rates may apply. Reply STOP to opt out or HELP for help, or switch the feature off in Settings, which deletes the number. Full detail is in our SMS consent record.
Acceptable use
Do not: attempt to access another user’s account or data; probe, scan or overload the service; scrape or bulk-extract data from it; circumvent rate limits or authentication; reverse engineer or copy the software; use it to build a competing product; or use it to break eBay’s rules or any law. We may suspend an account we reasonably believe is doing any of these, and we will give the reason unless we are legally prevented from doing so.
Availability
We aim to keep Lotwize running but do not promise it will be uninterrupted or error-free. It depends on services we do not control, eBay’s APIs among them, and an outage at one of those will affect it. We may suspend availability for maintenance.
Ending it
If you add employee seats. Each seat is an account with its own sign-in, and the work done under it belongs to your business and bills to your subscription. You are responsible for the people you invite and for telling them that their drafts and listings are visible to you. Deleting your account deletes theirs with it, including their drafts and photos; remove a seat on its own first if that person’s account should survive yours.
You may stop at any time: disconnect eBay, or delete your account in Settings, which removes your data as described in our Privacy Policy. We may suspend or close an account for a breach of these terms, for a legal requirement, or because we are discontinuing the service; except where a breach makes it impossible, we will give you notice and an opportunity to export your data first.
Disclaimers
To the fullest extent the law allows, Lotwize is provided without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that identifications or descriptions are accurate or complete, or that using Lotwize will result in sales.
Limit of liability
To the fullest extent the law allows, Lotwize is not liable for indirect, incidental, special or consequential loss, nor for lost profits, lost sales, lost data, eBay fees or penalties, or restrictions eBay places on your account. Our total liability for any claim is limited to the greater of what you paid us in the twelve months before the claim, or one hundred US dollars. Nothing here excludes liability that cannot lawfully be excluded.
Indemnity
You agree to cover our reasonable losses arising from listings you publish, content you upload, or your breach of these terms or of eBay’s policies.
Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Georgia, and you and we consent to that jurisdiction. If any part of these terms is unenforceable, the rest stays in force.
Changes to these terms
We may update these terms. The date at the top of this page changes when we do, and a material change will be announced in the application or by email before it takes effect. Continuing to use Lotwize after that means you accept the updated terms.
